Gambling business in Montenegro

Gambling is legal from the day of the declaration of independence of the state, ie. Since 2006. At the same time, the Law on Gambling was adopted, which allows casinos and other gambling establishments to operate. Anyone over the age of 18 can play in both land and online casinos. The gambling business is regulated by the Random Games Administration. All forms of gambling entertainment are available in the country - starting with the lottery and ending with the online casino.

A prudent casino-oriented policy ensures a large influx of tourists to the country, as well as impressive contributions to the country's budget. It is noteworthy that the income from the gaming industry is found in many social programs. Thanks to a quiet political and economic environment, Montenegro attracts the attention of many foreign investors. Today the Montenegrin gambling business is one of the most successful and actively developing. Fixes, prohibits and suppresses the activities of operators who violate the law.

By law, gambling entertainment is organized in the public interest. The funds received from the gambling business are used to meet the needs of social and humanitarian activities, program activities for young people and other purposes established by law. The state strictly controls the gambling industry and enforces the age limit (18 years).

In terms of legislation, entities that control the gambling market should pay special attention to the mental health of players. They also need to devote enough time to money laundering. This, in turn, helps reduce the risk of gambling business being criminalized, protecting players from cheating, and eliminating the negative manifestations that accompany gambling.

Companies registered as legal entities have the right to engage in gambling business. They must obtain proper registration by way of concession. Concession means the transfer of the right to use gambling equipment and gambling by the state to a limited liability joint stock company located in Montenegro. In return, the state gives the joint stock company remuneration in the form of lump sum or periodic taxes.

  • According to the law, the concession agreement must contain:
  • The name and location of the operating joint stock company of the gambling company;
  • Place and address of workplaces for organizing gambling;
  • The type of gambling that can be organized;
  • The start date of their organization;
  • The duration of the concession, as well as the conditions for its extension;
  • The amount and procedure of payment of the concession fee;
  • Rule of supervision;
  • Provisions on other rights and obligations of the Contracting Parties.

Due to preferential mechanisms, the state arranges and operates gaming through a number of controlled operators.

 

Gambling Regulators and Laws Governing the Gambling Industry in Montenegro

The main regulatory body of the gambling business is "Gambling Administration". According to the Law on Games, all control functions are performed by an authorized employee. His duties also include specific functions related to gambling control. The authorized employee is obliged to attend the opening, arranging and closing of tables and slot machines in casinos (gambling clubs with slot machines), as well as the daily payment of cash registers and other activities related to the activities of gambling establishments. .

Licensing in the gaming industry

Almost any entrepreneur who decides to start a gambling business on both land and online casinos) can get a gambling entertainment license. Each type of gambling requires a separate certificate of registration. For example, a slot machine certificate is issued for a period of 3 years, with the possibility of renewal for another 2 years. After the expiration of the certificate, the documentation is re-submitted and verified.

To get a gambling business license, you need to go through several pre-stages:

  • Establish a limited liability company in the territory of the Republic of Montenegro. The organization must be formalized in accordance with the rules dictated by law;
  • Prepare accounting accounts and open a bank account. You need to get a bank guarantee to prove your solvency;
  • Develop a website and payment processing system - when it comes to online gambling;
  • Compile and submit an application for registration of a new legal casino in the jurisdiction.
  • After completing these steps, the operator must obtain the permission of the Government of Montenegro. The conditions for obtaining a concession and validation are as follows:
  • A minimum of 300 thousand Euros of bank capital is required for casinos, or 75 thousand Euros for gambling clubs;
  • During the concession period and within 30 days from the expiration of its validity, have an account with the Bank of Montenegro in the amount of 30% of the value of the company's capital (or a bank guarantee in the amount of this amount);
  • At the casino cash desk should be at least 50 thousand euros per day for 5 tables, and for each subsequent 5 tables - 20 thousand euros (in the casino can be at least five tables);
  • It is necessary to pay preferential compensation to the state budget. 50 thousand Euros will be paid annually from one casino or other gambling institution and 10% of the institution's income every month;

Casinos are not taxed.
